《Regulations on Service Invention (draft)》 Open for Advice (May-2014)


The State Intellectual Patent Office (SIPO) published the 《Service Invention (draft for examination)》 on April 1, 2014 and open for advice.

Said Draft clarifies the procedure for determining a service invention relating to unit business between a unit and an inventor (see 10-13). The Daft stipulates that a service inventor enjoys three fundamental rights of (1) obtaining prize and reward; (2) the right to be informed of the information about intellectual property application, economic benefits and reward obtained at the unit, and (3) the right of authorship.

Said Draft also clearly stipulates that if a unit decides to keep a service invention as a technical secret, then the inventor is entitled to be paid with a reasonable compensation according to the Regulations (see Clauses 4 and 24).
